Someone harassed/hurt you and given false evidence against you in court?

Do you know presenting false evidence is punishable under law? Harassing or hurting a woman can bring a person before law?

We could see such incidents during family issues, at work place, or at a public place. Any such incidents which hamper a person’s rights, modesty and life should be reported and placed before the society to realize the duties and responsibilities of a citizen and to evade such incidents in future.

Punishment for false evidence. —Whoever intentionally gives false evidence in any of a judicial proceeding, or fabricates false evidence for the purpose of being used in any stage of a judicial proceeding, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine; and whoever intentionally gives or fabricates false evidence in any other case, shall be punished with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine.

Prompting false evidence, false statements before the court or evident that it hampers the rights of a person can be booked before law in many ways. It can be brought before a family court, human rights commission, or even a criminal code of procedure. The aggrieved can keep the records of such abuse electronically, or if it finds by writing or any statement, is enough to move before any of these constitutional institutions for justice.

What can happen if a public servant tries to save a person by framing illegal or incorrect reporting?

Public servants who are framing incorrect records or writing with intent to save a person from punishment or property from forfeiture shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both. If a public servant, corruptly or maliciously makes or pronounces in any stage of a judicial proceeding, any report, order, verdict, or decision which he knows to be contrary to law, shall be punished with imprisonment of either description for a term which may extend to seven years, or with fine, or with both.

When you find such false activities or actions, collect requisite documents by applying through RTI provision and can consult with your legal advisor to take up the matter at court. Similarly write a formal complaint to the higher authorities of the department to rectify the issue. Keep in mind that solid evidence is required in hand before you proceed with legal action.

3 pension schemes, we may forget to enroll

An interesting pension scheme for farmers, small traders or Vyaparis, and daily wage workers in our society. The Ministry of labour introduced Maandhan pension scheme for people who work in unorganized sector, avail Rs 3000 monthly in their account as pension from the age of 60.

Three of these pension schemes’ basic rules and benefits are similar.

Pradhan Mantri Kisan Maandhan Yojana

All Small and Marginal Farmers having cultivable land holding up to 2 hectares, whose names appear in the land records of States/UTs as on 01.08.2019

Pradhan Mantri Shram Yogi Maandhan Yojana

Unorganized Workers (UW) are mostly engaged as home-based workers, street vendors, mid-day meal workers, head loaders, brick kiln workers, cobblers, rag pickers, domestic workers, washer men, rickshaw pullers, landless laborers, own account workers, agricultural workers, construction workers, beedi workers, handloom workers, leather workers, audio- visual workers or workers in similar other occupations.

National Pension Scheme for Traders and Self-Employed Persons Yojana

Vyaparis, who are self-employed and are working as shop owners, retail traders, rice mill owners, oil mill owners, workshop owners, commission agents, brokers of real estate, owners of small hotels, restaurants and other Vyaparis with similar occupations whose annual turnover does not exceed Rs 1.5 crore

☛ Age: 18-40

☛ Pension benefit: Rs 3000/every month on bank account

☛ Monthly contribution: 18-40 = Rs: 55-200 (if you enrolled at the age of 18, you should contribute Rs 55 every month till the age of 60, Rs.55 will contribute government of India till the age of 60)

Note: applicants should not hold any other national pension schemes.

Can exit any time if not want to continue, paid amount with interest will be returned.

If applicant unable to pay, his or her spouse can continue the regular contribution.

If during the receipt of pension, applicant dies, his/her spouse will get Rs. 1500/ monthly.

How to join:

Go to the nearest Common Service Centre along with an Adhar card, mobile and bank passbook.
Centre will join you immediately and give you a Unique pension ID and Kisan/Shram Yogi/Vyapari card.
